Man sues Applebee's over dislocated shoulder

An  Oroville man has filed a lawsuit against Applebee's after he fell and dislocated a shoulder at the restaurant. 

Jose Jaime is suing for medical expenses and loss of wages as well as pain and suffering. In the complaint he filed in Butte County Superior Court, the amount of damages he's seeking isn't specified.

Jaime claims in his suit that he fell on a slippery cement floor that was wet from drinks employees were spilling. Employees carried drinks in their hands instead of trays, leading them to spill on the floor.

The area he fell in was between the bar floor and the restrooms. The bar lacked a big enough floor mat to cover the area, partly causing him  to fall, Jaime claims. 

Applebee’s is denying every allegation that Jaime is making. In its response to the suit, it says his fall was an “unavoidable accident/act of God.”
