Oroville Hospital faces lawsuit after termination of nurse



The complaint against Oroville Hospital


A former Oroville Hospital nurse is suing the hospital for firing her for being 40 years old and having a disability, she claims. 

Susan Staton of Oroville is suing Oroville Hospital for wrongful termination. Staton claims that she was fired because the hospital didn't want to accommodate her disability and because she was over the age of 40. 

Staton is suing for wrongful termination, violation of public policy, disability discrimination, negligent and intentional emotional distress, and breach of contract. 

She had been a registered nurse for Oroville Hospital since 2008 and worked for nine years until her termination in 2017. The lawsuit claims the hospital accommodated her disability for numerous years until deciding to stop.

Staton was a recovering alcoholic and was required by the Board of Registered Nurses to be monitored by another nurse while she was at work, which caused little to no disruption to the administration of the hospital, according to the suit.

Before being fired, Oroville Hospital stopped accommodating the monitor Staton needed to do her job. Staton had requested multiple times to have her accommodations back so she could work as the Board of Registered Nurses requested of her. 

Staton claims that Oroville Hospital chose to fire her for a younger nurse who didn't need the extra accommodations. 


This case is set to go to a case management conference on Oct. 2.
