Four Seasons Townhomes sues for sewage rights



Four Seasons Townhomes is suing the city of Chico for giving Campus Walk Apartments a permit to use its sewage pipes.

Four Seasons wants more than $25,000 in damages from the city for refusing to pay compensation fees and for breaking a contract the parties agreed upon.  

The pipe is located on private property and moves the sewage to the city sewer system.

In its lawsuit, Four Seasons claims the city was supposed to receive money from Campus Walk and then compensate Four Seasons for the sewer costs, beginning in August 2006, if the underdeveloped property (now Campus Walk) connected to the sewer line. 

The total amount of reimbursement from the time the issue began in 2006 is $281,819.44, the company claims.

Four Seasons’ owners did not originally seek compensation from the city because the city hired a third-party developer to connect the sewer line, the company says in the lawsuit. It also claims the area where the pipe is located is not the same area that was included in the original agreement between Four Seasons and the city.  

The suit was filed March 2. The parties haven’t negotiated a settlement.
