WinCo Foods employee sues over age and disability discrimination


    A former bakery manager at WinCo Food’s Chico location has filed suit against the company claiming that the company committed age discrimination and discrimination based on a past injury.
Michelle Samaniego is seeking more than $25,000 in damages.
Samaniego had worked at WinCo Foods since 1995 until she was fired last year,  according to her suit. At the time of her firing, she was bakery manager. 
She was given her job back after a grievance hearing, but she was not reinstated as bakery manager and her pay was subsequently reduced.
Samaniego alleges that she was demoted and her wages were reduced when she was rehired because of her age and the injury she received. 
In 2007, according to her suit, Samaniego suffered an injury to her forearms, for which she was treated.  She did not have to take time off work for the injury. 
She suffered a second injury in 2015 that was work-related and for which she received workers compensation.  
WinCo foods has not yet responded to the suit. 
Recently, WinCo foods fought and won a suit in which they were accused of depriving employees of meal breaks promised in a collective bargaining agreement. The case was appealed, and the court ruled in WinCo’s favor.
