Lawsuit accuses Oroville Post-Acute Care Center of negligence


The son of a former patient at the Oroville Hospital Post-Acute Care Center is suing the hospital after his mother’s death.

Randal Schmeltz is seeking more than $25,000 in damages related to Emily Schmeltz's death, according to court records.  He wants the cost of the suit covered, as well as hospital and medical expenses, and money for general damages. 

Emily Schmeltz died Aug. 15 while she was a patient at the care center.

In his suit, Schmeltz claims his mother was neglected and physically abused when she was a patient at the skilled-nursing facility. He also claims she was neglected while under the care of employees at the care center. 

Oroville Hospital Post-Acute Care Center is for people recovering from illness or suffering from a chronic illness, according to its website.  Care there is meant to help people transition from being in the hospital to going back home. 

Of the 50 people named as defendants in the suit from the care center, 25 are agents or employees of the hospital and the other 25 did not have a relationship with Schmeltz during her time of care, according to the suit. 

The care center did not comment on the case.
