Chico Unified School District sued by injured student




A teen and his mother are suing Chico Unified School District over an incident 20 months ago at Bidwell Junior High.
Dillan Melton and his mother, Cora, are suing for negligence, intentional or reckless conduct, assault and battery.
In the suit, they claim Dillon was assaulted by another student, Tyler David, before the start of the school day on March 7, 2017. He suffered three different breaks to the same leg, which required surgery.
The suit claims that the school district was negligent because school employees did not provide adequate measures to protect Dillan and other students from danger.
The Meltons also contend said the employees were legally responsible to provide for his “education and implement reasonable measures to prevent students from foreseeable injury at the hands of third parties acting negligently or intentionally.”
David is being sued for assault and battery. The Melton's suit alleges that he physically assaulted Dillan intentionally and that he should have known the consequences of his actions.
